Fallen swimming champion Grant Hackett plans to return to rehab after he was released by Gold Coast police.

But Craig Hackett said it was clear to the family his brother needed help.

The Nine Netowrk reports the 36-year-old was taken by his doctor from Southport police watch house yesterday then was taken to hospital.

A Queensland Police spokesperson said a man had been arrested "following a disturbance at a Surfer's Avenue address at Mermaid Waters around midday".

Hackett was later released without charge.

Hackett won 1,500 metres gold at the 2000 Sydney Olympics and at Athens in 2004 before retiring after the 2008 Games in Beijing, where he won silver in the event.

In 2014, he was seen barefoot and with just a singlet wrapped around his waist at Melbourne's Crown Casino.

Hackett was filmed being driven to the Southport watch house in handcuffs, and showed him resting his head on the seat of the police auto and appearing to raise his handcuffs to the window.

The 36-year-old made little secret that he had battled to adjust after professional sport and this latest incident comes as a huge setback in his efforts to reform his life.

He also courted controversy in 2014 when he was dishevelled and claimed he had lost his son at Melbourne's Crown Casino hotel complex, before seeking treatment in the U.S. for sleeping pill addiction.

Police are questioning Hackett, and it is understood he has not yet been charged.

As reported by the Gold Coast Bulletin, Nev said Hackett's arrest came due to the "mental health issues" he was facing. Witnesses claim he was "going off" and stabbing a chopping block.
